The author argues that the theory of a dorsal/ventral stream for visual processing can be used to reconcile the constructivist and direct perception theories. My commentary discusses neurophysiological and psychophysical studies that run counter to the view. In addition, the central issue of debate between the constructionist and direct perception approaches regarding what is visual information is discussed.

The law has therefore had two conflicting impacts on medical ethics: the positive effect of eroding paternalism and replacing it with a patient-centered ethic; and the negative effect of encouraging physicians to be more concerned with avoiding litigation than doing the "right" thing.

RECENT PHILOSOPHICAL ATTENTION TO THE LANGUAGE OF DISEASE HAS FOCUSED PRIMARILY ON THE QUESTION OF ITS VALUE-NEUTRALITY OR NON-NEUTRALITY. PROPONENTS OF THE VALUE-NEUTRALITY THESIS SYMBOLICALLY COMBINE POLITICAL AND OTHER CRITICISMS OF MEDICINE IN AN ATTACK ON WHAT THEY SEE AS VALUE-INFECTED USES OF DISEASE LANGUAGE. THE PRESENT ESSAY ARGUES AGAINST TWO THESES ASSOCIATED WITH THIS VIEW: A METHODOLOGICAL THESIS WHICH TENDS TO DIVORCE THE ANALYSIS OF DISEASE LANGUAGE FROM THE CONTEXT OF THE PRACTICE OF MEDICINE AND A SUBSTANTIVE THESIS WHICH (...) The proliferation of ethics committees and ethics consultation services has engendered a discussion of the issue of the expertise of those who provide clinical ethics consultation services. In this paper, I discuss two aspects of this issue: the cognitive dimension or content knowledge that the clinical ethics consultant should possess and the practical dimension or set of dispositions, skills, and traits that are necessary for effective ethics consultation. I argue that the failure to differentiate and fully explicate these dimensions contributes (...) to the confusion over the issue of expertise and fuels, at least partly, the controversies about expertise (or authority) in ethics and the legitimacy of the use of ethical knowledge in clinical ethics consultation. Method in ethics consultation has at least three distinguishable components: a canon – that is, the rules that guide actions, cognitions, judgments, and perceptions involved in performing an ethics consultation; a discipline – that is, a mastery, or at least possession, of the specific types of actions and intentions of ethics consultation which are guided by the rules that are embodied in the actions of competent ethics consultants; and a history – that is, the narrative of, and critical reflection on, (...) the actions, including the analyses, assessments, and communications undertaken in the course of the consultation, including the reasoning about the practical issues and the steps toward resolving the ethical question or issues that arose. As a doing, then, ethics consultation consists in actions and intentions that constitute a distinctive set of meanings in the clinical space of patient care in which the meanings brought to patient care through the actions and communications of the ethics consultation help shape, to some extent, the way that the case develops and is understood, which is further reflected in how the case is represented. In this sense, statements about ethics consultation methodology, and theories of ethics consultation, are secondary to the actual practice itself. The analysis and interpretation of actions and communications of those involved in the clinical care of the patient represents a complex process that blends the meaning of ethical concepts, principles, and theories with the constructed and uncovered clinical and value meanings of the case. This article discusses the approach of the Clinical Ethics Consultation Advisory Committee (CECA) in developing A Case-Based Study Guide for Addressing Patient-Centered Ethical Issues in Health Care. This article addresses the processes used by the CECA, its use of pivot questions intended to encourage critical reflection, and the target audience of this work. It first considers the salience of case studies in general education and their relevance for training ethics consultants. Second, it discusses the enfolding approach used in presenting the (...) case material designed to engage the trainee in the details of the case while stimulating critical reflection. And, third, this article briefly comments on the target audience with the caveat that even superbly developed cases are prone to misuse, although that prospect should not deter their development. The realities and myths of long-term care and the challenges it poses for the ethics of autonomy are analyzed in this perceptive work. The book defends the concept of autonomy, but argues that the standard view of autonomy as non-interference and independence has only a limited applicability for long term care. The treatment of actual autonomy stresses the developmental and social nature of human persons and the priority of identification over autonomous choice. The work balances analysis of the ethical concepts (...) associated with autonomy with discussion of the implications of the ethical analysis for long term care. A central chapter involves a phenomenological analysis of four general features of everyday experience (space, time, communication, and affectivity) and explores their practical implications for long term care. This work concludes with a discussion of the advantages associated with a phenomenologically-inspired treatment of actual autonomy for the ethics of long-term care. (shrink)

In the Optics, Descartes claims that telescopes and microscopes lead to morally certain knowledge. It is unclear, however, that Descartes’s expressed confidence in these instruments is warranted. In this article, I show how a limited range of telescope and microscope observations could lead to morally certain knowledge for Descartes, and how observations beyond this range admit of enough reasonable doubt to undermine moral certainty. I also explain moral certainty as a form of knowledge in Descartes’s scientific practices, his epistemic commitment (...) to optical instruments, and I offer an explanation for why Descartes never used optical instruments in his scientific endeavours. -/- ---- -/- Dans la Dioptrique, Descartes prétend que les télescopes et les microscopes donnent accès à des connaissances moralement certaines. Cependant, il n’est pas certain que la confiance accordée par Descartes à ces instruments soit justifiée. Fraudulent financial reporting, financial statements with errors so material as to require restatement, and biased reporting marred by defects such as managed earnings have plagued financial reporting in many countries in recent years. All of those failures are ethics failures that represent breaches of fiduciary duties by individuals who accepted responsibilities but did not fulfill them. The financial reporting system practiced in America is viewed by the parties involved in it as generally satisfactory. However, according to another view, the interests (...) of those primarily and secondarily responsible for those reports conflict with the interests of the intended beneficiaries, or users, of the corporate financial statements. A more realistic view of the actual operation of that reporting system shows that it is fundamentally flawed. Primary responsibility for failures rests with top management and financial management of the reporting corporation who are so strongly motivated to render favorable reports on their stewardship that they neglect their fiduciary responsibilities to investors. Secondary responsibility falls on independent auditors who are so heavily influenced by enterprise management that they, too, fail in carrying out their responsibilities to users of the audited financial statements. Ethics compromises are also found in the performances of academic accountants and members of accounting standards-setting bodies. The conflict between managements interest in reporting its performance in a favorable light and investors interest in decision-useful financial information will always exist and require regulation. However, changes in those regulations and in the basic governance arrangements involving shareholders, management, and auditors could reduce the opportunities and temptations for failures in carrying out fiduciary responsibilities. Most importantly, the close relationships between auditors and management must be loosened in favor of closer relationships between auditors and investors. (shrink)

In lieu of an abstract, here is a brief excerpt of the content:150. A HUMEAN PATTERN OF JUSTIFICATION Interpretations of Hume have tended to fall into two categories: naturalistic and sceptical. Those which fall into the former category see Hume as letting justification rest upon a system of natural beliefs which can neither be supported nor overthrown by reason. Those in the latter category see Hume's point as being essentially negative, that all attempts at justification either within or without a (...) framework of natural belief are doomed. My aim in this paper is to argue that neither naturalistic nor sceptical interpretations do justice to Hume. Instead closer attention must ' be paid to a general pattern- of justification which Hume uses, a pattern which does not rely on "natural beliefs" and which, obviously, since it is a pattern of justification, is not sceptical. My approach will be to avoid either of these two extremes by concentrating on a pattern of justification which equates justification with rationality. However, in order to do this, it will be necessary, first of all, to provide some account of what Hume means by rationality, especially as concerns its connection with truth. As we shall see, Hume's notion of justification requires that some basis in the truth be provided whenever we believe something to be worthy of acceptance. Second, it will be necessary to introduce the factor of foundations. As I see it, a foundation, for Hume, is a mechanism or some component of a mechanism for the production of belief in epistemic areas or of evaluation in moral and aesthetic areas. The concept of foundation is an explanative, not a justificatory, notion. But, although all references to foundations are made for the purpose of explaining why someone has a certain belief or makes a certain 151 evaluation, some foundations in addition provide a basis for justifying a belief or evaluation. I My main contention is that, for Hume, all justification depends on a judgment's truth. Truth is the sole criterion of justification. Since truth lies at the base of Hume's practice of justification, some account of his views on it must be given. At the outset, it is vitally important to pay attention to the notions of truth and falsehood and the related notions of the truth-values, true and false. As I shall argue, when these terms function as part of Hume's semantic vocabulary, they serve to indicate what sorts of things can have a truth-value in the sense of having specifiable kinds of truth-conditions. On the other hand, when they function primarily as epistemic terms for Hume, they serve to indicate that the truthvalue of some item can be known or established. Consequently, Hume must first distinguish the semantic class of entities that are potential bearers of the truth-values "true" or "false", and then he must distinguish from among the members of this class those which have the epistemic status of having known truth or falsehood, i.e., an ascertained truth-value. Let us, then, first consider Hume's semantics in order to find out what sorts of items he believes have truthvalues and what sorts of truth-conditions these items may have. In an important passage in the Treatise, Hume implicitly draws the distinction between the semantic and epistemic considerations mentioned above: Reason is the discovery of truth or falsehood. Truth or falsehood consists in an agreement or disagreement either to the real relations of ideas, or to real existence and matter of fact. Whatever, therefore, is not susceptible of this agreement or disagreement, is incapable of 152. being true or false, and can never he an object of our reason (T458). What sorts of things are incapable of this agreement or disagreement? Hume continues by. giving this reply: Now 'tis evident our passions, volitions, and actions, are not susceptible of any such agreement or disagreement; being original facts and realities, compleat in themselves, and implying no reference to other passions, volitions, and actions.
